General Terms & Conditions

1. Scope of application and validity

a) These General Terms and Conditions (hereinafter "GTC"), together with an individual event confirmation (hereinafter "Contract"), govern the conclusion, content and execution of contracts for the provision of services for the implementation of the outdoor team building event "Rhein & Raus" (hereinafter "Event") by Thomas Meierhofer Unternehmensberatung (hereinafter "Organiser") for the benefit of customers (hereinafter "Participants").

b) If the contract and the GTC contain divergent provisions, the provisions of the contract shall take precedence over those of the GTC. However, if the provisions of the contract are unclear or incomplete, the provisions of the GTC shall apply.


c) The validity of any general terms and conditions of the participant is hereby excluded.

2. Conclusion of contract

The organiser offers its services online on its website. The participants express their interest in a customised arrangement and corresponding offer for the event via the contact form or similar. By placing an order on the basis of the offer, participants unconditionally accept the GTC of the organiser. The contract is concluded as soon as the participant receives an order confirmation by e-mail.

3. Realisation of the event and third-party services

a) The organiser carries out the events in accordance with the agreement with the participant. The prices offered include the concept, the organisation, the loan of the material required for the event (survival equipment, swimming aids, etc.), various consumables (food, fire starters, etc.) and the staging of the event in Weiach.


b) On request, the organiser will also arrange additional services from partner companies (hereinafter referred to as "third-party services"), such as catering services, as a supporting programme for participation in the event. The third-party services can be provided by these partner companies and invoiced by them. The organiser accepts no liability for the availability, quality and safety of the third-party services provided.

4. Payment terms

Participants pay the amount by bank transfer up to 14 days before the event when the contract is concluded. The participant is responsible for the timely payment of the fee within the payment period. In the event of late payment, the participant shall owe a reminder fee of CHF 50.00 per reminder.

5. Postponement and cancellation of the event


a) Cancellation and changes to the number of participants for unspecified reasons:

Up to 14 days in advance, participants may change the number of participants at no cost. This includes a full cancellation. If the number of participants increases significantly, the participant must expect a proportionate increase in the price of the offer.

Up to 5 days in advance, the number of participants can be changed or the event cancelled with an administrative fee of up to 50% of the total price. Thereafter, the full costs must be paid. Exceptions are weather-related measures (see c).


b) Adjusted schedule due to weather conditions:

Some of the organiser's offers can only be carried out in dry weather and are marked accordingly in the offer.
The following alternative options are offered by the organiser up to 3 days before the event:

i) Cancellation of the affected part of the event (e.g. the whole day becomes a half-day adventure because the afternoon river trip is cancelled)

ii) We organise an indoor team building afternoon or a leisure activity for everyone (e.g. a visit to the spa) after the outdoor part.


The offer and the associated costs are adjusted accordingly and communicated transparently.

6. Ownership, proprietary and intellectual property rights

a) The material provided to the participants (survival equipment, swimming aids, etc.) remains the property of the organiser. In the event of loss or grossly negligent damage, the participant shall owe the organiser compensation of up to CHF 300.

7. Liability and insurance

a) Participants take part in the event at their own risk. Insurance is the responsibility of the individual participants.

b) The organiser's liability is excluded to the extent permitted by law. The organiser is not liable for slight negligence.

c) The exclusion of liability also applies in the event of unlawful intent and gross negligence on the part of auxiliary persons.

8. Data protection

The organiser's general data protection provisions, which form an integral part of these General Terms and Conditions, shall apply.

9. Modifications

a) The Organiser reserves the right to amend the GTC at any time. The organiser shall inform the participant of any changes to the GTC in a suitable manner in advance.

b) Should a provision of the contract between the organiser and the participants be or become invalid, this shall not affect the validity of the remainder of the contract. The contracting parties shall replace the invalid provision with a valid provision that comes as close as possible to the intended economic purpose of the invalid provision. This provision shall apply accordingly to any loopholes in the contract.

10. Place of jurisdiction

The courts of Zurich shall have jurisdiction over any disputes arising from this contract. The contract is subject exclusively to Swiss law.
